Please read these Terms of Use carefully before using the TourCrew application (“the App”). By downloading, installing, or using the App, you agree to be bound by these terms. If you do not agree, please do not use the App.
TourCrew is a volunteer-led project developed and operated by Simon van den Berg (“we”, “us”, “our”). The App is designed to help parents coordinate volunteer spots at sport fundraising events.
There is no tolerance for objectionable content or abusive users. We will use reasonable efforts to remove content and users that violate these terms as soon as practicable after a report is reviewed.
You must be at least 13 years of age to use TourCrew. By using the App, you represent that you meet this requirement. Accounts are created by your fundraising organisation’s administrator and activated by you using an invitation code.
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, solely for the purpose of coordinating volunteer activities within your fundraising organisation. You may not:
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
You agree to use TourCrew only for its intended purpose: coordinating volunteer spots and communicating with other parents within your fundraising organisation. You must not:
You are solely responsible for any content you submit through the App, including chat messages, swap request messages, and response notes. By submitting content, you represent that it complies with these terms.
Other users may report content or users they find objectionable. When a chat message is reported, the message, its sender, and the timestamp are sent to your organisation’s administrator for review and may be retained for moderation or audit purposes for up to 6 months, as described in our Privacy Policy. Reports are reviewed by your organisation’s administrators. We reserve the right to:
We will use reasonable efforts to review reports and take appropriate action as soon as practicable. As TourCrew is operated by volunteers, we cannot guarantee a specific response time.
Users may also block other users to prevent further interaction. Blocking prevents direct chat messaging and swap requests between the two parties. Messages posted by a blocked user in shared group chats may still be visible to other group members.
All rights, title, and interest in and to the App — including its design, code, graphics, logos, and content (excluding user-submitted content) — are owned by us. Nothing in these terms grants you any right to use our trademarks, branding, or other intellectual property without our prior written consent.
The App includes gamification features such as XP points, cap levels, high fives, and leaderboards. These features are for engagement and recognition purposes only and have no monetary value. We reserve the right to modify, reset, or discontinue gamification features at any time.
We may suspend or terminate your access to the App at any time, without prior notice, if you violate these terms or engage in behaviour that is harmful to other users or the platform. Your fundraising administrator may also remove your account at their discretion.
You may delete your account at any time from the Profile screen in the App. Upon deletion, your personal information will be permanently removed as described in our Privacy Policy. Please note that chat messages you have posted are not automatically removed on deletion, as they form part of conversations shared with other users; they remain visible to other participants but are no longer attributed to your name. This is explained further in our Privacy Policy.
The App is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We make no guarantees regarding the reliability, accuracy, or availability of the App.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. This includes, but is not limited to, loss of data, missed volunteer assignments, or any disputes between users.
Our total liability for any claim arising from your use of the App shall not exceed the amount you paid to use the App (which is zero, as TourCrew is provided free of charge).
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to our collection and use of information as described in the Privacy Policy.
We may update these terms from time to time. We will notify users of material changes through the App or by email. Your continued use of the App after changes are posted constitutes your acceptance of the updated terms. The “Last updated” date at the top of this page indicates when the terms were last revised.
These terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from these terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of New Zealand.
